1973 War Powers Act Essay
1. If no judicial court of authority, namely the United States Supreme Court, has stricken the 1973 War Powers Act and declared it null and void constitutionally, how is it that the authors of the text book are able to conclude Congress has few, if any, war powers remaining? How can this be? The law is the law, is it not? (Specifically, explain the political phenomenon that has occurred here and has similarly occurred in other legal and constitutional matters allowing the law to be ignored.) The authors of this text book are able to conclude that Congress has few, if any, war powers remaining because of historical actions. For instance, Congress has not declared war since December 1941, yet the US has been involved and engaged in many Military Campaigns since 1941 under the orders of the president. This situation seems to have come about via many different reasons. One of the reasons that this has happened according to our book was that presidents have claimed that they have inherent executive power to defend the nation. A second reason was that when Truman dispatched American forces to Korea without a congressional declaration, and in the face of the emergency, Congress felt it had to acquiesce, and so passed a resoloution approving the presidents actions. This became the pattern for future congressional-executive relations in the militay realm. 2. Attempting to think as objectively as possible and placing your political partisan beliefs aside (looking at presidents as just that, presidents, as opposed to Democratic or Republican presidents) what does the increase in presidential unilateral military power do to the United States as a nation, for better or worse? (There is no correct answer, yet think through the checks and balances consequences.) As the sign on President Trumanââ¬â¢s desk, ââ¬Å"The Buck Stops Here,â⬠presidents throughout the years have adhered to their power as chief executive officer with leagal and constitutional responsiility to ensure that the articles of the Constitution are faithfully executed, along with the power to appoint, remove and supervise all executive officers etc, the president truly is the true CEO of the US. It seems that this power has been taken literally by the presidents dating all the way back to George Washington. The good in this happening is that one chief has say in wha t happens.

Now that I have your attention, Iââ¬â¢d like to come to my topic about the ascendancy and deprivation that pop culture has made; first of all, I believe that pop culture is a reflection of social change, and not the cause of social change. The fairly aged generation may argue and say that media is the devil. In my opinion, I believe they are just contradicting themselves; how can one side with media when it fits their cultural beliefs and previous experiences but side against it when media previews other point of society views? Pop-culture is all around us indeed. Music, television, and street posters are one of the most commonly used methods in viewing media. The pros and cons of pop culture weigh each other out. To me, media is a matter of optimism and pessimism; for example, ââ¬Å"is the cup half empty, or half full? a more related example to our current life style are women in the virtual world. A little inside about how women are perceived in media is that they are tall, thin, organized, and always running a perfect, healthy life style. An optimistic person would find this as a motivational ââ¬Å"pushâ⬠to his/her life; whereas a pessimistic person would find these goals unreachable, and wouldnââ¬â¢t try pushing themselves to their limits. Thus, media is not the influencer neither the influence, but rather a source of entertainment and a way of propagating information to the world in order to stay united as one union.

The evolution of social media has led to a dramatic change in the way people communicate professionally. In 2002, a professional networking corporation launched a business and employment website that has replaced the way individuals apply for jobs. The website named ââ¬Å"LinkedInâ⬠has made it easier for employers to find their employees. According to the Economist, ââ¬Å"it is an online contact bookâ⬠where one no longer finds the need to walk into a workplace with their resumes in hand when they can search for jobs from the comfort of their own homes. ââ¬Å"LinkedIn connects individuals seeking or starting work, or simply wanting more from their careersâ⬠. Those seeking employment simply create a LinkedIn profile, listing valid information about themselves such as skills, qualifications, job history etc. This results in an online resume that can be viewed by other professionals and allows them to get in contact with you. According to one of its founders Allen Blue, it is a ââ¬Å"network of peopleâ⬠; traditionally, employees seek employers. However, LinkedIn gives the employer the option to find the employee they are looking to recruit, making LinkedIn an online social network where employers and employees are able to connect with one another. In addition, LinkedIn has made it easier for companies to recruit persons with the required skills or assets by enabling the option to ââ¬Å"actively search for Candidates around LinkedIn members by using keywords.â⬠This means that employers can simply input the traits of interest and LinkedIn will provide a list of potential candidates that meet the employer's requirements. LinkedIn has created a massive change in the market for their labour-how they find jobs and how employers find them.While developments in social media have made it easier for individuals to find employment or recruit employees, it has also made it easier for employers to check up on the applicant that is about to undergo the hiring process. According to an article ââ¬Å"56% of employers check applicants Facebook, LinkedIn, Twitter etc.â⬠While this process may be invasive to some, it allows the employer to make a good judgement before hiring someone who may not be the best fit for the job. An individual's behaviour may contradict the mission or purpose of the organization. For example, if the owner of a rehab centre is looking to recruit new employees, a person who posts content of alcoholic beverages in multiple pictures of their Facebook profile is not someone that would fit the job position or title accurately. Though the individual may meet the employer's requirements and expectations, they have failed to make an appropriate judgment on the types of content they release to the public eye. When employers check an individual's social media networks, it is not for the purpose of invading one's privacy, but to prevent them from making a decision they may regret in the future.In addition to posts on social media, employers impose limits on employees towards what they can and cannot post out into the public. This relates to socially unacceptable behaviour that can lead to affirmative action taken against the individual for not abiding with the company's rules, leading to termination. An aggressive comment towards another individual or group that may indicate violence or considered offensive would be in contradiction with the company's terms or regulations. The employee would then receive disciplinary action due to negative impact imposed on the company. Furthermore, socially unacceptable behaviour on social media includes political or religious views or stereotypes. For example, topics that your parents don't allow you to discuss at the dinner table, your employer does not want it discussed on social media. Certain words can get a lot of recognition on social media especially if used in an incorrect manner.(hatecrimes) This can cause disorder and damage relationships in the work place as well as the general public.

It is the right of the party to a contract to demand that the defendant (the party who it is claimed breached the contract) be ordered in the judgment to perform the contract. Specific performance may be ordered instead of (or in addition to) a judgment for money if the contract can still be performed, and money cannot sufficiently reward the pla intiff (Ibid). The basis for the grant of this remedy is equity. Doctrine of Partial Performance The doctrine of partial performance is an exception to the requirement prescribed by the Statute of Frauds that any agreement to transfer land must be written and executed. Partial Performance of an oral agreement can render it as a binding contract (Gervais et al, 2010). The essence of this doctrine was that if the plaintiff could show that he or she had acted under the contract - had partly performed the contract - then a court of equity would enforce the contract even though a court of law would not. The doctrine of part performance requires that the plaintiff must be able to show that he or she has made a substantial commitment to the contract so that it would be unconscionable to allow the defence. Note that it must be the acts of the plaintiff. The doctrine is based on the idea of unconscionability generated by the plaintiff's reliance on the existence of a contract. It does not ma tter whether the acts of the defendants clearly show that there is a contract (Heffey et al. 1998). Difference between the two doctrines and their application to construction cases The invocation of Specific Performance is based on a written contract or any agreement entered into by the parties. And non-performance of any provision or stipulation in the contract will make the erring party liable for breach of contract and an action for specific performance will be granted as in the case of Kasten Construction Co. v. Maple Ridge Construction Co. There is no blanket prohibition against a court ordering the equitable relief of specific performance in a case involving breach of a construction contract as held in the case of Granite Broadway Dev.Ã LLC v. 1711 LLC. However, this doctrine of specific performance is rarely a remedy in construction cases. If a contractor fails to perform or renders defective performance, it is unlikely than the owner will want the court to order the same c ontractor to continue the work. As we are well aware of the fact that elasticity of concrete is all most the same at low stress levels but tends to decrease as the higher stress levels are attained as matrix cracking develops. The content of cementitious material, along with the water content determine the final strength, durability, abrasion resistance, shrinkage values and many other properties. Females and males had equal but complementary roles in traditional Aboriginal life Essay The purpose of this report is to show that women and men shared many roles in Traditional Australian Aboriginal life. It is acknowledged that men and women were given equal and complementary roles when it came to ceremonies, hunting and gathering, raising and initiating the children, building shelter and throughout the leadership hierarchy. This is proved through evidence collected and presented in the following paragraphs. The roles of both men and women were important and neither was thought to be as more significant than the other. While men had certain roles and women had other roles, they complemented each other which made day to day life easier and more bearable for the group. There were many different types of ceremonies performed by the Australian Aboriginals. Some ceremonies performed were initiation ceremonies, funeral ceremonies, cleansing ceremonies and ceremonies to great other tribes or groups of Australian aboriginals onto their land. During initiation ceremonies, young boys and girls begin the journey to become a man or woman. They are often taken away from the group and left in the bush to be shown and taught by the elders. The elders will pass on the laws relating to their country, spiritual belief and the role and obligations they have within the tribe. [1] This ceremony is performed by both men and women and each role they play complements the other. While men look after the young boys and women look after the young girls, without their roles complementing each other, neither group would be able to co-exist. In funeral ceremonies, both men and women elders would smoke out a house where a person may have died. This is to rid their community of the potential of the deceasedââ¬â¢s bad spirits coming back. They also find the last place the deceased person was and smoke it for the same reason. [2] During this ceremony, they would often cut open their own flesh to show their pain and sorrow because one of them had passed. They sung and danced to ensure the deceasedââ¬â¢s spirit had left to return to its birth place where it was to be reborn into the world. [3]Without both the men and women complementing each other throughout this ceremony, they would not be able to be performed. Aboriginal people believe that when a person dies, their spirit goes back to the Dreaming Ancestors in the land. This is only possible if certain ceremonies and rituals are performed. They used dances and special songs in times of death or mourning periods. It is also thought that when a person dies they are one with the land again, so often, the aboriginal group will vacate the area that a group member died. It is unsure whether this is out of respect or out of fear that the spirit will return and haunt them. They will return to the place sometime within a year and bury the bones of their dead group member. All other ceremonies that are performed by the Australian Aboriginals were able to be performed by both male and female members of the group. Some also include other groups or tribes. It is known that the Australian Aboriginals were avid hunters. They had a very deep knowledge of their land and believe they were born of it. They also had great knowledge of water sources and seasonal changes which affect the type of food readily available to them. They were knowledgeable about certain foods which were poisonous to them and knew when and how to avoid them should they ever come across these foods. Both males and females made different but complementary contributions when it came to hunting and gathering. The roles of both men and women were complementary in that they worked together to gather food to prepare a meal. Women gathered things such as vegetables, eggs, honey, roots, fruit, and small reptiles such as snakes and goannas. Mostly, the men hunted larger animals such as emus and kangaroos as well as birds. [4] The preparing of such foods was done by both the men and women. It is believed that women were the main carers of young children in traditional Australian Aboriginal society. However, during initiation, the men took over the role of caring for the young boy so they could be taught the laws of the land. When a young boy was roughly six years of age, he would go and join the male adults to learn about hunting and food gathering while the young girls would remain with the women to learn about different things such as child bearing, child rearing and food gathering [5] Because of a combination of nomadic lifestyle and the regions sunny climate, aboriginal people believed there was no need to build shelters or dwellings. The shelter that was used in permanent camps consisted in a frame made from saplings, or straight branches, covered with materials that were available locally such as leafy branches or sheets of bark. In some areas the covering of the shelter was sheets of soft paperbark, which were pulled down from trees. In other areas they used bushes and leafy branches instead because the bark was not available. Australia has such a mild climate, most of the time, they would sleep in the open, and warmth was often provided by a fire or two. They would sometimes be accompanied by a dingo or camp dog, which would also provide warmth to the man or women who it slept beside. During the wetter and colder seasons, they sometimes used closed dome-shaped shelters which were made with a frame of different sized sticks bent over, which joined in the middle to make the dome shape. They were not very big, standing between one and two metres tall. The frame for these was covered with whatever materials that could be found locally such as sheets of bark, layers of soft grass and leaves. [6] Both men and women would collect and assemble the shelters used as well as the campfire. Sometimes they had daytime fires which needed protection from the wind, so they used bushes and branches as a windbreak. Women would gather the leafy branches and bark that is needed to make the roof while the men would gather the saplings and/or the straight branches used to make the frame. Another form of shelter used when available was small or shallow caves that were often hidden behind rocks or bushes. These provided natural shelter for the nomadic Australian Aboriginals. [7] Both men and women had various roles when it comes to leadership in the Aboriginal culture. Both genders would contribute in leading ceremonies, tribal or group meetings and hunting parties. Although it is often shown that men have the main role of being an elder, women also were elders. Elders were leaders of the group who shared knowledge of the laws surrounding the land and how each member of the group intertwines with another. Elders are valuable members of each aboriginal tribe or group as they bring the wealth of knowledge and pass it down generation to generation. While male elders bring knowledge of hunting bigger animals, laws of the land and initiation, female elders bring knowledge of child irth, food gathering and child rearing. The knowledge used by both male and female members of the group helps them to become one with the land. In conclusion, in Traditional Australian Aboriginal life men and women were proven to share roles and complement each other through various ways. Through raising children, hunting and gathering, ceremonies and in leadership they comple ment each others roles so that the tribe or group can exist harmoniously. While men seem to have the main role throughout the Australian Aboriginal culture, it has now been proven that without the complementary role of women, the group would not continue to coexist.

Concerned With Voluntary Euthanasia J. David Velleman and Dan W. Brock are both concerned with voluntary euthanasia; a competent patient making a voluntary request to have his or her life ended. The arguments laid out in Vellemans, Against the Right to Die, and Brocks, Voluntary Active Euthanasia deal with active and passive voluntary euthanasia. Active being that the patient actively takes the last step in their death, while passive is usually defined as withdrawing medical treatment with intent to cause death. They do not consider cases involving involuntary euthanasia, when the patient is competent and refuses treatment. Nor do they consider non voluntary euthanasia, when the patient isnt competent at all. Many people believe that giving legality to voluntary active euthanasia (VAE) will in turn lead to involuntary and nonvoluntary euthanasia, the slippery slope fallacy, but for the purposes of this paper Im only concerned with VAE. Both authors agree that anyone could possibly be morally entitled to be allowed or h elped to die. However, Velleman argues against an institutional right to die. He believes that making the choice of voluntary active euthanasia available to the people can make them worse off even if they choose the option that is best for them. The ability to make a choice makes one worse off than going with the default option. In this paper, Im going to analyze Vellemans arguments while explaining how Brock responded to Vellemans arguments. To keep the integrity of each authors thoughts, I am going to use similar word phases which will be identified in quotes and later labeled with the paper number of reference. Velleman agrees that we have an obligation to assist some deaths, however he disagrees with those who use Kantian terms to justify such an obligation. He explains that voluntary active euthanasia deals with two major rights a person has, according to Kantian moral theory. They have the right to dignity and their autonomy. A multitude of life-preserving treatments are said to, violate a persons dignity or to detain him in an undignified state (Velleman, pg 2). A patient has the right of autonomy, or self-determinism, which is that we respect his/her competent wishes even if its a wish to die. Velleman goes on to explain how these rights become confusing when dealing with Kantian language in the terms of medical ethics. He has reservations about the loose definitions which dont match up with the extreme states of patients who are in question while dealing with euthanasia. Because of these qualms, Velleman disregards these Kantian-based arguments and moves on. Aside from problems in definition, VAE is dealing with other peoples autonomy. If laws are to be made which prohibit this autonomy, than these laws should make people better off. Velleman feels he has an answer to this dilemma which leads to his second argument against the option of euthanasia being given to patients, but unlike the first, this reason is consequentialist. When Velleman speaks of his consequentialist reasoning, he isnt referring to the consequences of mistakingly choosing to die, but instead, the consequences of placing such an option in the hands of the patient. He believes that giving patients this option will actually make them worse off. Im going to explain how Velleman attempts to prove this and then give the objections laid out by Brock. Contrary to natural thought, if we are given a second option besides the default, it will make us worse off than before no matter which option is chosen. Velleman explains this idea with an example of a cashier who is given the power to open the safe. Its not that the cashier doesnt directly want the power, but rather, it would make him a target for robbers. Even though opening the safe while at gun point would be the right thing to do, hed be wishing hed never been given the option of doing it (Velleman, pg 8). This makes him worse off because he can no longer have the default option, not being forced to open the safe at gun point, without choosing it. Multiple options become available and he is now subject to the pressures of possibility. Relative to euthanasia, this is the most important way of harm. We would be denying a patient the status quo of staying alive by default, with the option of euthanasia looming over his head. Because of this, the patient will now see himself in con trol of his own survival, which is ordinarily viewed as given to him. If the patient sees himself as this agent of control, then he will be held responsible for his actions by himself and others. He would then be required to justify his actions, whether it be his continued existence or choice of euthanasia. The burden of justifying ones existence might make existence unbearable and hence unjustifiable. (Velleman, pg 11) It may be perceived as insecurity, but justifying oneself personally and to others is extremely important to those who are ill. When the gift of independent activity is taken from someone, personal intercourse and intercourse with others is the only relief left in life. And so, unless he can defend his existence to the satisfaction of others, his only reasons for life may disappear. A patient who believes that his terminal illness is not an ample reason for ending his life with be faced with the burden of proof. Even if the patient believes that his life is worth living, he may find reasons to assume that those around him think otherwi se. Reasons ranging from the financial or the emotional costs of prolonging life may cause him to rationally judge that he is better off taking the option of euthanasia (Velleman, pg 12-13). Therefore, Velleman believes that if we offer the option of dying, than we may give patients new reason to choose death. Through the preceding arguments, Velleman is lead to believe that euthanasia should be permissible in some cases, yet still forbidden in others. However, he doubts that policymakers could define such conditions in which the option of dying would be beneficial and when the option of dying would be harmful. This leads him think that the best solution to the problem is allowing health professionals to decide. They should be given the power to permit, and never require, the option of euthanasia or to grant the patients request for it (Velleman, pg 19). It would be possible define certain conditions when the option should never be offered, but we cannot define conditions when euthanasia should always be offered. If put into effect, caregivers could withhold the option whenever they see fit, even when requested. Velleman claims that we already put so much trust into health professionals that this would serve as an effective solution. However, he still believes that the best policy of eutha nasia is no policy at all. Velleman states that he is inclined to believe that advances in medical technology have outrun the capacity of institutional rules to regulate their application. (Velleman, pg 20) And so, the policy regarding euthanasia should be weak and vague by design, left up to the individual health care professionals and the patient in question. (Velleman, pg 20) Dan W. Brock takes the opposite stance as J. David Velleman, believing that there should be an established institutional right to die, as stated in his article, Voluntary Active Euthanasia. He lays out many positive and negative potential consequences of euthanasia, but feels strongest about protecting patients right to autonomy. I will briefly explain some potential positive and negative consequences of euthanasia, but will focus more on his direct responses to Vellemans argument. Some potential good consequences of euthanasia include: giving the general public a broader sense of control over their life and death, showing mercy to suffering patients, and once death is undeniable in certain cases its more humane to do it quickly. Some potential bad consequences of euthanasia include: its not compatible with physicians moral and professional commitment as healers; to protect life, and euthanasia could weaken societys commitment to providing optimal care to the sick. Brock directly calls out Vallemans solution to the euthanasia problem and refutes it. Velleman argues that offering the option of euthanasia would make patients worse off than if not given the option at all. This leads Velleman to conclude the best solution is health care professionals having the power to permit, and never require, (Velleman, pg 19) the option of euthanasia or to grant the patients request for it. In doing so, situations in which there are unmistakable and over- powering reasons for persons to want the option of euthanasia (Brock, pg 19) would be the only cases granted it. Brock lists three main reasons why such restrictions wouldnt lead to the best outcome. First, polls and other evidence tend to show that most Americans do, in fact, believe that euthanasia should be allowed. Consequently, the amount of people made worse off by having the option wont outweigh those made better by having the option. Second, if people would be made worse off by the option of a right t o die, than why dont we see any consequences of voluntary passive euthanasia? People already have the option to refuse life-sustaining treatment and there is no evidence of harmful effects or public desire to take away such right. How would establishing an institutional right to active euthanasia make any difference? To this argument, Velleman has a refute. He states that the option of refusing life-sustaining treatment to end ones life may be just as harmful as having the option of active euthanasia. However, the proportions of deaths that occur as a result of passive euthanasia is very small, making the side-effects very small as well. Also, these side effects are to be accepted as an unavoidable byproduct of protecting the right not to be assaulted. Assaulted in this case as morally entitled to refuse treatment because we are morally entitled to not be drugged or punctured with needles. Third, there is a wide range of conditions that are reasonably disagreed about in the terms of euthanasia. If Velleman suggests restricting euthanasia to persons whose conditions indisputably call for it, than we would be denying the most amount of people who want it. In conclusion, Velleman and Brock disagree on whether to establish an institutional right to die or not. Velleman argues that establishing such a right would burden those given the option of euthanasia, that to offer an option of dying gives new reasons to end ones life. Because of this, he suggests the solution of a weak and vague euthanasia policy by design, left up to the individual health care professionals and the patient in question. Brock argues for an institutional right to die. He lists possible positive and negative outcomes and directly refutes Vellemans conclusion with three arguments. Brock and Velleman could go back and forth all day arguing and refuting each other. However, I believe that they disagree in the simple fundamentals of the situation. Brock believes that an individuals well-being and control over his or her own life far outweighs any impact on society, while Velleman believes that even the option would make patients and society worse off overall.

INTRODUCTION Pakistan as a developing country has very limited health care resources whenà considering a huge population of over 170 million. We have very few tertiary careà hospitals and they are providing services to the whole country. Majority of people inà our country are poor and they are unable to afford the expenses of private hospitals,à though private hospitals are also very few. Thousands of doctors are unemployedà and still we have shortage of doctors. Majority of BHU (Basic Health Units) areà closed as majority of doctors belong to urban areas and they donââ¬â¢t want to work inà remote village areas. In all these situations, it is very difficult to maintain healthà care throughout country. In this essay, I will take into account four conditions ofà accountability for reasonableness for priority setting and resource allocation. I willà take into account these four conditions by Norman Daniels and I will consider aà tertiary care hospital scenario where I did my house job in medicine ward last year. There were majority of patients suffering from chronic liver diseases (CLD). I willà further continue this essay in discussion. DISCUSSION Before discussing the four conditions of accountability for reasonableness, I willà briefly discuss the case scenario. In my medicine ward as I earlier said majority ofà patients were of chronic liver diseases (CLD) and it includes Hepatitis B, Hepatitis Cà and cirrhosis of liver. Cirrhosis is the end result of hepatocellular injury that leadsà to both fibrosis and nodular regeneration throughout the liver. The clinical featuresà result from hepatic cell dysfunction, portosystemic shunting, and portalà hypertension. Cirrhosis may cause no symptoms for long periods. One of the majorà complications is uppergastrointestinal tract bleeding which may occur from varices,à portal hypertensive gastropathy, or gastroduodenal ulcer. Hemorrhage may beà massive, resulting in fatal exsanguinations or enencephalopathy. Esophageal varicesà are found in 50 % of patients with cirrhosis. There are several treatment andà management options available for esophageal varices includin g acute resuscitationà as initial management, pharmacologic therapy, balloon tube tamponade, portalà decompressive procedures and emergent endoscopy. Endoscopic techniques are alsoà used for prevention of Rebleeding. 1. Now, I will discuss my case scenario. In ourà hospital there is one associate professor who is trained in doing endoscopy andà Wednesday is fixed for performing endoscopies. Emergent endoscopy is performedà after the patientââ¬â¢s hemodynamic status has been appropriately stabilized (usuallyà within 2-12 hours). Majority of poor patients come to hospital in end stage liverà diseases. I have taken this case series as it is a perfect example of scarce resources. Many patients faced problems as their endoscopies were not performed on time asà there was only one day fixed in a week. Now I will apply the four conditions ofà accountability for reasonableness for priority setting and resource allocation. Theseà four conditions are publicity condition, relevance condition, revisions and appealsà condition and regulative condition. Accountability for reasonableness makes ità possible to educate all stakeholders about the substance of deliberation about fairà decisions under resource constraints. It facilitates social learning about limits. Ità connects decision making in healthcare institutions to broader, more fundamentalà democratic deliberative processes. 2. In my case scenario I will apply the fourà conditions as follows. The first one is publicity condition. It states that decisionsà regarding limits to care and their rationales must be publicly accessible to clinicians,à patients, and citizens in a publicly administered system. When the patients sufferà the complication of esophageal varices, they are informed about the limited capacityà of the ward to arrange endoscopy as it is done on only Wednesdays and surgicalà ward have their own burden of patients to be done endoscopies, due to this reasonà we were unable to send patients to surgical wards and the patients and theirà relatives mostly agrees on this setup and if their was any emergency only then weà take help from surgical ward or send the patients to any other hospital, so the firstà condition is fulfilled. In above scenario second condition is also fulfilled which isrelevance condition. It states that the reasons for limit-setting decisions will beà reasonable if it appeals to evidence, reason, and principles that are accepted asà relevant by fair-minded people who are disposed to finding mutually justifiableà terms of cooperation. In my case scenario the decision making is according to theà framework. The rationales w ere reasonable as it is evident that we had limitedà facility of endoscopy and it was fairly accepted by patients and their relatives andà also by doctors and other hospital staff. In our setup priority was given to thoseà patients who needed emergency endoscopy rather than those who requiresà endoscopy for diagnostic procedures. The third condition is revisions and appealsà condition. This condition is a very common problem in government hospitals and inà our scenario we request consultants from surgical ward to do emergency endoscopyà if we think patient is serious and he or she may die if the endoscopy is notà performed on time or in other case the other hospital is very far so that it will be lateà if we send the patient to other setup and here comes the function of oncallà consultants also, the oncall consultants plays huge role in these emergencyà situations. This third condition is a mechanism for challenge and dispute resolution regarding limit setting decisions, including the opportunity for revising decisions inà light of further evidence or arguments. 3. Thus we fulfill the third condition also byà revising our decisions as I explained above. The fourth and last condition isà regulative condition or enforcement. There is either voluntary or public regulationà of the process to ensure that conditions 1-3 are met. This condition is also fulfilled inà our setup as we communicate with the patient and their relatives about our limitedà resources. We are able to convince patients in our case scenario. The hospitalà leadership is constantly making efforts to meet the conditions of ââ¬Ëaccountability forà reasonablenessââ¬â¢. 4. CONCLUSION In this essay I have discussed all four conditions of accountability forà reasonableness, for priority setting and resource allocation. ââ¬ËAccountability forà reasonablenessââ¬â¢ is a framework that can be used to guide legitimate and fair priorityà setting in health care organizations, such as hospitals. In our beloved countryà Pakistan we have few government civil hospitals bearing the burden of millions ofà population. We try our best to server the humanity. Iam not claiming this system aà perfect one, it needs a lot of improvement and the example is my case scenario inà which we have very limited resources. Government should establish civil hospitals inà small cities also and should increase their budget; they should recruit more doctorsà and nurses as we have shortage. They should train doctors with latest equipmentsà and provide hospitals appropriate medicines. In addition to this all the hospitalsà should be provided with computers and also be made online so that a data systemà can be established and it can help the patients and also hospitals for futureà reference. Magnets are one of the fundamental items in physics. This page is designed in order to provide a general overview of magnets and their uses as well as an in depth look into certain aspects of magnetism. We all know certain situations where magnets are used, hanging things on a refrigerator for example. But other applications are much more useful in our society. They are used in all kinds of speakers, and in many computer parts including hard drives and floppy drives ( for recording and reading purposes). Perhaps a more common use that goes unnoticed is the magnetic strip on credit and debit cards. These have a certain magnetic makeup, that is why you are to keep them away from other magnets. Magnets are also used in many motors, in such items like a dishwasher, DVD and VHS players, and a pager or cell phone vibrator. Magnets are all dipoles, that is they all have both a north and a south pole. No known magnetic monopoles exist. Looking at magnets from a basic point of view, opposites attract and similars repel. Magnetic field lines always move from the north pole to the south pole, we will discuss this later. Some of the major contributors to magnets are men like Hans Christian Oersted, James Clark Maxwell, William Scoresby, Michael Faraday and Joseph Henry. Hans Christian Oersted experiment with a wire carrying a current and a compass led to much of what we know about Magnetic Fields. James Clark Maxwell discovered relationships between electricity and magnetism many of which are used in the Electromagnetic Theory. More information on the relationship between magnets and electricity can be found here. William Scoresby used the Earth's magnetic fields to produce powerful magnets. Michael Faraday and Joseph Henry are reported to have simultaneously discovered electromagnetic induction, which is the effect whereby the relative motion of a magnet and an electric coil produced a current. There are three types of magnets. Permanent, temporary, and electromagnets. Permanent magnets are the most common ones. Once they are magnetized they stay so (although they can lose much of their magnetic force). They can be metals found in nature. Temporary magnets hold the properties of a magnet while in a magnetic field, but lost these properties once the field goes away. An example of this would be a paper clip that is charged and can act like a magnet for a short while. Electromagnets are wires wrapped around a metal center(usually iron).

War dates back to the earliest of ages. Leaders have come out triumphant and countries have come out ravaged. Entire generations have been extinguished and humanityââ¬â¢s morale destroyed; all at the cost of a victory. Everyone is familiar with war, however we are not so quick to understand the lasting toll it takes on those who experience it for themselves. War has been fought through out many countries for various reasons since the beginning of times, the tactics and warfare themselves may have changed, but the meaning of war remains the same. In turn the soldiers, whom give it all in the name of their countries, never come back the same. It is glittered with words like glory, honor and devotion, however war, in my eyes, is anything but. It brings about many more problems, one of which is the substantial psychological effects it has on those who experience war first hand. World War I was said to have been the war to end all wars. We now know that not to be true as there have been countless wars since that proposition. The attitudes surrounding the initiation of World War I were very distinct from that of proceeding wars to come. Citizens were excited, families were proud to know that their sons were enlisted and patriotism and brotherhood were alive and well. Young men were very much encouraged to join the war effort and advertisements soliciting the call to arms were seen in a positive light. Enlistment was something expected of these young men, they wouldnââ¬â¢t dare be the ones to be ââ¬Å"ostracizedâ⬠or called ââ¬Å"cowardâ⬠. With no way around the Great War many did indeed join the armed forces; little did they know what they were in for. ââ¬Å"A word of commandâ⬠, and a powerful one at that, put these young men on the path to destruction. ... ...rd we take, as a war to end all wars was virtually never in sight. I believe that the state should not by itself have the power to declare war on another nation or country without the consent of the national government. the reason behind why I think this is because I believe that the government itself has enough power to keep the branches and there paper works in order and to do what is needed and expected of them to do nothing easel over that or under. I also believe that we south Carolinians if we do not like what north Korea is doing we should just stay out of it unless north Korea brings us into it and the reason I think this is because, us south Carolinians declaring war on north Korea just because we donââ¬â¢t like what they are doing is pretty stupid to me. I believe we are smart enough to figure it out without declaring war on a country or a nation. If south Carolina is having problems maintaining their drinking water supplies, and if the government has attempted numerous times to correct the problem, but has repeatedly failed, I believe that the government should problem get help form a nether government or help from whoever can fix this problem because we need water and without water we will die. I believe that the national government should beagle to take action because it is a life or death situation so yes I think that the government of South Carolina also known as the local government should be able to get help from the national government and take the measures needed to fix this problem. I believe that the local government should try to figure it out before getting help from the national government, and if the national government canââ¬â¢t fix it then I think that the national government should beagle to ask another government for help to fix this life or death situation. But if they need to shut down the factory then they should do it because if the south Carolinians donââ¬â¢t have any water they could die and they need water because water was made to keep us alive just like food was made to keep us alive without water you canââ¬â¢t take a shower either and so everyone would stink. If the local chemical factory is causing this problem then they need to shut the chemicalà factory down and move it to a different area so it canââ¬â¢t cause anymore problems to our water systems and we would need to move it to a place where it canââ¬â¢t contaminate anything that could herm us or bother us like were its not close to a farm food supplies or water supplies.

I was lucky to interview someone from the RTW Garments industry and whose day seems endless from deadlines and fast phased fashion trends to chase. He is Mr. Dave Smith. He graduated in an art school, majored in advertising and decided to pursue Graphics artistry as a career. What do you like/best worst about your job/work? What I really love about this job is the access you get to the latest trends in graphic designs and the fashion shows that only few famous people that works in the industry knows of until it hits the magazine stands sort of a VIP pass. Well, developing new trends is also one of those and also seeing other people buying and appreciating your work would be the most rewarding thing that can happen. Well, the worst would be getting your most loved works be rejected for its not in season, its out of budget or for some insane random reason they have up their sleeves. Office politics sometimes kicks-in too but thatââ¬â¢s another thing. What are the steps necessary to break into the field? It was hard at first breaking into the industry when you want to make it big as a fresh graduate. The worst part about it was, the companies taking advantage of your status. I experienced being paid below minimum wage for quite some time, and all that youââ¬â¢re left to do is be patient and gain experience from all of it. But with my goal at an aim on my mind, Iââ¬â¢m now in one of the leading brand there is in this industry. The basic would be getting to know what software to use and why. Some of it is Photoshop, Corel, Illustrator and Freehand. Another investment that you must have is a quirky imagination to stand out and create something new. If you donââ¬â¢t have it, you must know the latest trend there is and what sells in the market, have a market survey and what appeals most of your target market. Browsing through magazines and the internet is a must to survive, for it helps you formulate what other possibilities there is in a particular design/look you want to achieve. Thereââ¬â¢s also the printing aspect of it, which a graphic artist must also be armed with. So that youââ¬â¢ll know or have a peek of the end result of the artwork you did. Itââ¬â¢s definitely a plus if you know at least some of it. What is a typical day like for you? A typical day for me would be buried in the computer for a long period of time. As in long, until I can dig a hole in my chair at the office. Its either you search for references for whatever seasoned collection your boss wants you to do, what your mind ticked you to do, or youââ¬â¢re doing promotional item before you knew it. Well, in the place I work in I never had a single day without having a new assignment to work on. What are some related occupations to your profession? As a graphic artist, you can choose which field to specialize in. You can be in the garments, in a printing company, product development division, as photo editor, as a companyââ¬â¢s only graphics artist whoââ¬â¢ll do their collaterals. There are really so many job opportunities as a graphic artist, as long as it involves photo editing and vectors. Do you see yourself doing the same job till you get older? Yes I do see myself being in the business till I age. I mean, it pays well to people who are experienced, who perseveres and also as long as I feel that being a Graphic artist fulfill my purpose. One thing more, if you really enjoy what you are doing you, you felt the fulfillment in every thing that you do, definitely you will stay on the job your in. What made you decide to pursue this profession? I decided to pursue this because it makes me feel accomplished as an artist, as a designer, as a human being who appreciates art, it makes me feel happy that at the end of the day I know I can make someone feel confident, happy, at-home with their statement with my designs. Itââ¬â¢s like I liberated someone from being a fashion victim, because I care for what other people look like, and because its feels great to lift someone up in a different way. I do believe that Fashion is good for the soul every once in a while. A boost of confidence one design might give, getting your message across through the artworksââ¬â¢ you did. Itââ¬â¢s all worth-it even though the deadlines are next to impossible sometimes, and the revisions are inevitable, but still I have to go up there because I know in my own way Iââ¬â¢m helping other people feel good about themselves. After this interview I had, I have a deeper reason why I should pursue to be a Graphic artist. With all the things my interviewee mentioned, I have a deeper knowledge and appreciation of who I want to be. Whether what field of graphics designing I want to concentrate on. There are really so many choices. Iââ¬â¢m sure I can pick out something that I like among it. I know it will take me a lot of hard work, patience, and determination to be able to achieve my goals. In addition to that the job also pays well, I donââ¬â¢t mind being in front of the PC for such a long time, as long as I know that I can express my ideas and thoughts very well thorough the means of designing and I have to agree also with what Mr. Smith told me, that it feels great to make someone better through your work, and thatââ¬â¢s really fulfilling as an artist.

Music Composition: Pirateââ¬â¢s Dinner Adventure
Music has a way of adding life and energy to any performance, many musicals, commercials, films, live shows, and concerts sweeping people off of their feet by the colorful compositions of the musicians. In adding depth and dimension to characters, music has a way of bringing emotions to surface through the use of sound, meaningful beats and rhythms pulsing audible story tales into the ears and souls of the performers and audience members. Louder and more intense sounds, like deep booming, have the effect of grounding the music, while softer and often higher pitched compositions, like gentle piping, have the effect of lifting the music. Feelings such as anticipation, anger, joy, sorrow, peace, and frustration can be communicated through sound, and people are in tune with the ways in which music arouses them. These various types of sounds are produced by a wide range of unique instruments, including horns, drums, and strings. Each distinct instrument and sound has a part to play in the overall composition of the music, every element bringing a certain kind of meaning and emotionality to the overall performance. In experiencing the performance of the Pirateââ¬â¢s Dinner Adventure, one is thrust into a historical world of swashbuckling action, pirates taking to the stage, in boats and though water, in the battle for the ship of treasures and the princess. Each part of the musical composition has meaning and purpose, the deeper horns and drums creating a sense of anticipation and fear, a mixture of expectation and dread. This booming introduction is followed by the appearance of pirates on the stage, creeping through the water and floating in on their small boats, each one determined to fight to the finish and win the battle for riches and the lovely woman. This slow beating of the drums is threaded through with low to medium pitched horns, such as tubas, leading the skulking pirates closer to their final goal, the wealthy ship full of gold and the fine girl. Some pirates pop up above the water with knives in their mouths, surprising the audience, as the drums beat out in almost perfect synchronicity with their small splashes, and the leisurely gliding boats fill the viewers with dread as the music pipes out the horns, their stealthy movements and whispers carried by each rich tune. When the pirates raid the ship, the music explodes and quickens, higher pitched horns, such as trumpets, pound out the action of the climbing men, rope swinging pirates, firing canons, and sword fighting bandits. The soldiers lose control of their ship, and the music floods with horns, the shrill cries of the instruments sounding out the struggles and screams of a waterborne battlefield. The knives flying through the air and the pieces of the ship falling down onto the deck and into the water are pierced with drumming, and the pushing and falling people, the fighters, are suspended in a torrent of drumming and horns, each instrument pulsing out a rhythm which is busied yet integrated, hectic but blended to suit the frantic interweaving of battle. The music calms and the strings enter into the composition when the soldiers finally take control of their ship once again, having banished the pirates from the area, and having reclaimed their treasure and their princess. With the brash and brazen pirates effectively cast out, the peaceful and gliding sounds of the violins, flutes, and chimes bringing the culmination of the show to a soft and quiet ending. These higher pitched instruments are most effective when played lightly, the soothing tinkling of these sweet instruments resembling the gentle nature of the female, and symbolizing the safety of the princess and the treasure. This performance was extremely rich in musical emotionality, each instrument and sound bringing a certain and unique element of beauty and meaning to the piece. Initiating into the slow, deep beginning of anticipation, moving through the wild and loud rhythmic racket of battle, and culminating with the soft and gentle high sounds of peace was a poignant experience rich with significance. The magnificence of the deep drumbeat and shallow tubas was followed by the excited piping of trumpeters and quicker beats, finally cascading into the chiming flow of the violins and flutes. A story can be effective without the use of music, but telling a tale interwoven with melodies can capture elements of the heart and soul through the use of a comprehensive and engaging harmony of sounds.

Santiago Calatrava Biography Santiago Calatrava is a Spaniard who was born in Valencia in the early 1950ââ¬â¢s. He is one of the most renowned engineering based architects. He is also a sculptor in addition to being an architect and a structural engineer. He got his first bachelors degree from the Polytechnic University of Valencia. He graduated with an honors degree in architecture. He followed this with a post graduate degree in urbanism. He later on moved to Zuri ch in Switzerland where he graduated with an honors degree in Civil Engineering from the Swiss Federal Institute of Technology. It was until he got his doctoral degree that he began practicing his engineering and architecture. He wrote a thesis on Space Frames foldability. Calatravaââ¬â¢s engineering background. Calatrava spend his early career in engineering based architecture concentrating on bridges and train stations. This was in the early 1990s. Even at this early stage of his career, he came up with projects that were revolutionary in nature. He changed the horizon for the engineering based architectural industry. His designs were magnificent. He was very lucky to be granted a spotlight at the early stage of his career by the international Olympic Games. These games were hosted in Barcelona in his home country of Spain. He had just completed his Muntjuic Communications Tower. This was right in the middle of the Olympic site. With the full glares of the worldwide cameras, he stole the show with his design. It was a spectacle. This was followed by the Allen Lambert Galleria in the Canadian capital of Toronto. These projects marked the point of revolution in his career. He never looked back. Since then things have never been the same again in his line of work. He has risen to be an icon.
